Long Leaf Acres is a single-family home subdivision in Wilmington, NC. These covenants run with the land and bind all current and future lot owners. The document sets rules for residential use, building setbacks, minimum floor area, and architectural review.
- Residential use only: All lots are for residential use. Only one detached single-family dwelling (max 2.5 stories) plus a private garage (max 3 cars) and incidental outbuildings (including servants quarters) are allowed. No trailers, basements, tents, shacks, garages, barns, or temporary structures may be used as residences.
- Building setbacks: Dwellings must be at least 50 feet from the front lot line, 10 feet from side lines (15 feet for two-story structures), and 25 feet from the rear lot line. Unattached garages or outbuildings must be at least 100 feet from the front line and 5 feet from side lines.
- Minimum floor area: Each dwelling must have a minimum floor area of 1,250 square feet, excluding porches, garage, terrace, and outbuildings.
- Nuisance & pets: No noxious or offensive trade or activity is allowed. Only household pets (domesticated animals) are permitted.
- Sewage disposal: Until a sewerage system is available, sewage disposal must be by septic tank approved by the NC State Board of Health. Once available, sewerage must be used.
- Architectural review: Plans for all dwellings and structures must be approved by a three-member building committee: one member is the owner (or representative), and two are elected by lot owners (one vote per lot) for four-year terms (initial two-year term for one member decided by lot). The owner has authority to approve or disapprove committee decisions.
- Duration & amendment: These covenants run with the land until January 1, 1983, and automatically extend for successive 10-year periods unless a majority of lot owners vote to change them in whole or in part.
- Enforcement: Any lot owner may sue to enforce these covenants, seeking to prevent violations or recover damages. Invalidation of one covenant does not affect others.
