What Inland Harbor Yacht Club's governing documents say
Inland Harbor Yacht Club is a non-profit corporation that owns and manages boat slips, docks, and common areas for owners of units in Inland Harbor Condominiums. Membership in the club is tied to owning a condominium unit and purchasing a boat slip certificate. This document governs the rights and obligations of members regarding boat slip use, assessments, and transfer of membership.
- Membership eligibility & rights: Only owners of units in Inland Harbor Condominiums are eligible to apply for membership. Each member has the exclusive right to use a specific boat slip and a right to use the common area, subject to the corporation's rules.
- Leasing & rentals: A member may lease their membership rights only with prior board approval, which cannot be unreasonably withheld. The board sets the application procedure. During a lease, the lessee has full use of the membership, but the member retains the right to vote.
- Transfer & right of first refusal: Before selling or transferring a membership, the member must first offer it to the corporation at the same price and terms as the highest bona fide offer. The corporation has 30 days to exercise its option. Intra-family transfers (to spouse, child, sibling, or parent) are allowed with board approval, which cannot be unreasonably withheld. Any transfer without compliance is voidable by the corporation.
- Assessments & fees: Members must pay monthly assessments and may be subject to special assessments. The initial annual assessment is $120 per slip. Special assessments over $200 in a fiscal year require approval by two-thirds of voting members. Assessments are a lien on the membership and a personal obligation of the member.
- Use restrictions: No commercial use of boat slips, docks, or common area is allowed without board approval. No obnoxious or offensive activity is permitted. The board may adopt and enforce rules and regulations for use of all property.
- Architectural control: No structures (buildings, fences, signs, etc.) may be erected or altered on common area without board approval. Dock boxes are allowed only as approved by the board.
- Maintenance & insurance: The corporation maintains all its property, including bulkheads, docks, piers, pilings, and performs maintenance dredging. The corporation may insure its property against fire and other hazards and carry liability insurance. Members may insure their personal property separately.
- What this document doesn't cover: This document does not cover rules for the condominium units themselves (e.g., interior maintenance, pet limits, noise restrictions within units), nor does it specify the exact amount of monthly assessments beyond the initial $120 annual figure. It also does not address parking, guest policies, or age restrictions.
