Foxcroft Subdivision is a single-family home community in Wilmington, NC, governed by restrictive covenants that run with the land. These rules apply to all lot owners and residents, promoting a uniform residential character.
- Residential use only: Lots may be used only for residential purposes, except Lot 28 which may also host a community water supply system. No commercial, noxious, or nuisance activities are allowed.
- Building & dwelling requirements: Only one detached single-family dwelling (max 2 stories) and a private garage for up to 2 cars per lot. Minimum heated living area: 1,100 sq ft (excluding porches, garage, carport). At least 60% of exterior finish (excluding roof) must be brick, brick veneer, stone, wood, or masonite siding. No garage apartments.
- Setbacks & fences: Front setback: 30 ft from street line. Corner lots: 25 ft from the street the building faces, 20 ft from the other street. Side setback: 8 ft from side lines. Fences cannot extend beyond the front setback line and max height 4 ft.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock. Dogs, cats, or other household pets allowed, but not for commercial purposes and not in numbers that become a nuisance.
- Temporary structures & vehicles: No trailers, mobile homes, tents, shacks, or outbuildings used as residences. No inoperative junk cars or unsightly vehicles on lots or streets.
- Maintenance & debris: Buildings must be kept in good repair. After fire or casualty, debris must be cleared within 90 days. No dumping of rubbish; trash must be in sanitary containers. Yards may be cleaned by developer at owner's expense if not maintained.
- Signs: Only 'for rent' or 'for sale' signs allowed, max 2 ft by 3 ft. No other sign boards.
- Utilities & easements: Developer reserves easements along property lines for utility installation/maintenance. Water for human consumption must come from the community water system unless approved otherwise. Sewage disposal by septic tank only until a general system is installed.
