Colton Park is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). All lots (except Lot 7) are subject to restrictive covenants that run with the land, binding current and future owners. The HOA collects annual assessments to maintain common areas and enforce rules.
- Residential use only: Lots may be used only for private residences. No apartments, duplexes, businesses, or professional offices are allowed. Temporary structures like trailers or mobile homes are prohibited except during construction.
- Architectural review: All building plans, exterior colors, landscaping, and site alterations must be approved in writing by the Declarant (or its architectural committee). - Parking & vehicles: Each lot must provide off-street parking for 3 automobiles. No trailers, boats, or habitable motor vehicles may be parked on the property unless inside an enclosed garage. No parking on common easement areas.
- Pets & nuisances: No noxious or offensive activities are allowed. No plants or animals that are dangerous, unsightly, or diminish enjoyment of the property are permitted. Firearms discharge and hunting are prohibited.
- Assessments & liens: Annual assessments are set by the HOA and due January 1 (may be paid in installments). Unpaid assessments become a lien on the lot after 30 days, bearing 12% interest. The HOA can foreclose on the lien. Budgets must be ratified by lot owners; 80% rejection can block a proposed budget.
- Signs, mailboxes, antennas: Only one routed wood 'For Sale' sign (max 2'x2') on improved lots, or a small sign (6"x1') on unimproved lots. Mailboxes and satellite dishes require Declarant approval. Exterior radio/TV aerials are not permitted.
