What Alford Landing's governing documents say
Alford Landing is a small, single-family home community in Wilmington, NC, with only three lots. Each lot owner owns their home and land, and shares responsibility for a private driveway and a dock/pier with boat slips on Hewletts Creek. The rules are set by the original developer and run with the land, binding all current and future owners.
- Residential use & minimum home size: Lots are for residential use only, with one primary residence per lot. The primary residence must be at least 2,000 square feet. Guest houses or garage apartments are allowed if they match the main house's design. Mobile homes, modular homes, and temporary structures (trailers, tents, etc.) are prohibited, though RVs and campers may be on a lot as long as they are not permanently occupied.
- Dock/pier & boat slips: Each lot comes with a 20-foot boat slip on the shared dock/pier. Boat slips cannot be sold separately from the lot, but owners may trade slips by recording a notarized document. Slips may only be rented to another lot owner. All owners share equally in the cost of maintaining and repairing the dock/pier and boat slips, and may vote to install utilities or buy insurance, with costs shared equally.
- Architectural & design control: All construction, renovations, paint colors, driveways, fences, and other structures require prior written approval from the Declarant (or its members) as long as they own a lot or a nearby tract. If the Declarant and its members no longer own any lot or that tract, approval rights pass to the lot owners. Plans are considered approved if no response is given within 30 days.
- Maintenance & nuisances: Owners must keep their lots mowed, clean, and free of junk, debris, and inoperable vehicles or appliances. No noxious or offensive activities are allowed. Livestock (horses, pigs, chickens, etc.) are prohibited; household pets are allowed but must not create a nuisance.
- Private driveway & utilities: A private driveway from Greenville Loop Road serves the lots, with an easement for ingress/egress granted to each lot owner. Maintenance responsibilities are set out in a separate recorded agreement. Utility easements are shown on the recorded map and further defined in that agreement.
- Amendment & voting: As long as the Declarant or its members own at least one lot or a specified nearby tract, they can amend the restrictions without other owners' approval. Otherwise, amendments require a majority vote of lot owners (each lot counts as one vote).
- Enforcement & legal costs: The Declarant or any lot owner may enforce these restrictions through legal action. The prevailing party in any enforcement litigation, arbitration, or mediation is entitled to recover costs and reasonable attorneys' fees.
- What this document doesn't cover: This declaration does not establish a homeowners' association, set regular assessments or fees, or address leasing/rental restrictions beyond boat slip rentals. It also does not cover parking rules, noise limits, or specific pet limits beyond prohibiting livestock.
