Raintree Subdivision is a single-family-home HOA in Wilmington, NC. These restrictive covenants run with the land and bind all current and future lot owners. The document sets rules for residential use, minimum house size, setbacks, and property maintenance.
- Permitted use: Lots may be used only for residential purposes. No commercial trade or activity is allowed, and no noxious or nuisance activity is permitted.
- Building & size requirements: Only one detached single-family dwelling and a private garage per lot. Minimum dwelling size is 1,700 square feet (excluding porches, garage, carport). Detached garages must match the residence in material and style.
- Setbacks & location: Buildings must be at least 10 feet from side and rear lot lines, and 40 feet from the front lot line. Eaves up to 3 feet and uncovered stoops/steps may encroach into setbacks.
- Architectural review: Plans for all dwellings and other structures (including garages and outbuildings) must be approved by Raintree Development Corporation (or its successors). Submitted plans must include a plot plan showing distances from lot lines.
- Vehicles & parking: Buses, trucks over one ton, unsightly or inoperative cars, and similar eyesores cannot be kept on any lot or street. No fence or obstruction may extend nearer the street than the rear line of the main dwelling.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock. Dogs, cats, or other household pets are allowed, but not for commercial purposes and not in numbers that become a nuisance.
- Maintenance & nuisances: All buildings must be kept in suitable repair. Debris must be cleared within 90 days after fire or casualty. Yards must be properly maintained; the developer may clean them at owner's expense. No dumping of rubbish or trash except in sanitary containers.
- Signs: No signboards except 'For Rent' or 'For Sale' signs on residential lots.
