Tonbo Meadow is a planned community of townhomes in Wilmington, NC, governed by a homeowners' association under the North Carolina Planned Community Act. You own your lot and dwelling, but the association maintains common elements and the exterior of your home (limited common elements). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that applies to all owners.
- What you own & maintain: You own your lot and the townhome on it. The association maintains all common elements (e.g., private roads, stormwater facilities, open space) and limited common elements, which include the exterior of your dwelling (roof, siding, decks, porches, gutters, downspouts).
- Association membership & voting: Every lot owner is a member of the association. Each lot gets one vote. During the Declarant Control Period (until December 31, 2023, or earlier), the developer holds Class B membership with three votes per townhome, giving it control of the board.
- Assessments & fees: Owners pay annual assessments, special assessments (approved by 2/3 vote), insurance assessments, ad valorem tax assessments, and a one-time working capital assessment of $300 at purchase. Assessments are liens on the lot if unpaid for 30+ days.
- Architectural review: The Declarant (developer) or its designee serves as the Architectural Control Committee during the Declarant Control Period, with authority to approve or deny changes to lots and structures.
- Developer rights: The developer retains special declarant rights, including the ability to annex additional property within one mile, amend the declaration without member approval in certain cases, and re-plat lots. These rights expire when the Declarant Control Period ends.
- Insurance: The association must maintain casualty and liability insurance on common elements (at least 80% replacement cost, $1M liability). Owners must insure their own lots individually and name the association as additional insured.
- Easements & access: The association and developer have easements over lots for utility installation, maintenance of limited common elements, and emergency access. Owners cannot obstruct these easements.
- What this document doesn't cover: This declaration does not specify rules about pets, leasing (minimum lease terms), parking, age restrictions, or rental caps. Those may be addressed in separate association rules or amendments.
