Cedar Landing is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). These restrictive covenants apply to all lot owners and set rules for construction, use, and maintenance of the property.
- Architectural review: All buildings, fences, walls, and other structures require prior written approval from the Declarant (or its architectural committee). Plans must include exterior colors, finishes, site and landscaping details. The Declarant has sole discretion to approve or deny based on any grounds, including aesthetics.
- Minimum house size & setbacks: Each house must have at least 2,400 square feet of enclosed dwelling area (excluding garages, decks, porches). Front setback is 50 feet, side 15 feet, rear 50 feet. Variances are allowed to preserve views, land contour, and trees.
- Residential use only: Lots are for single-family detached homes only. No duplexes, apartments, businesses, professional offices, or religious institutions. No trailers, mobile homes, or temporary structures (except contractor shelters during construction).
- Parking & vehicles: Each lot must provide off-street parking for three cars. No trailers, boats, or recreational vehicles may be parked on the property unless inside an enclosed garage.
- Pets: Only dogs, cats, and pet birds are allowed, in reasonable numbers for personal use only—no commercial breeding or boarding.
- Assessments & liens: Each lot owner must pay annual assessments set by the HOA, due January 1. Unpaid amounts become a lien on the lot and bear 12% interest. The HOA may also levy additional assessments for emergencies.
- Construction timeline & debris: Exterior construction must be completed within 12 months of starting. Builders must keep the site clean and remove debris; stumps and trees cannot be dumped in the subdivision.
