Emerald Cove is a townhome subdivision in Wilmington, NC, governed by a homeowners' association (HOA). This declaration of covenants, conditions, and restrictions (CC&Rs) applies to all lots in Phase 2 and binds all owners, their heirs, successors, and assigns. It establishes rules for residential use, property maintenance, architectural control, and HOA assessments.
- Lot use & restrictions: Lots are for residential use only; no business, manufacturing, commercial, or professional purposes. The developer may construct multi-family housing. No temporary structures (trailers, tents, etc.) as residences, but a storage building up to 8x10 feet may be placed behind the main residence with HOA approval.
- Architectural review: All building designs, exterior colors, and changes must be approved by the developer or HOA. Dwellings must be brick veneer and/or vinyl siding. Exterior color changes require written permission. The developer has 10 days to approve or disapprove plans; failure to respond means approval is not required, but the design must harmonize with existing structures.
- Maintenance & landscaping: Owners must keep their lot neat and tidy, maintain exterior of buildings, and repair/replace roofs (jointly if shared). The HOA maintains front, side, and back yards not fenced in, and no landscaping other than that provided by the developer/HOA is allowed. Fenced areas on common property are limited common areas maintained by the HOA but maintained inside by the adjacent owner.
- Parking & vehicles: No more than three motor vehicles per lot or on the street in front. No parking on lawns or common areas except designated spaces. No inoperative vehicles, tractor-trailers, or mechanical work in front/side yards or streets. Boats may be stored only in emergencies for up to three days.
- Pets: No livestock or poultry. Up to four household pets (dogs, cats, etc.) per lot. Pets must be confined in a fenced area or on a leash, and owners must clean up pet debris. Costs for debris removal may be assessed against the owner's lot.
- Signs & window coverings: No 'For Sale' or 'For Rent' signs except by developer or with HOA permission. White mini-blinds must be installed in all windows within 10 days of occupancy. Television antennas and satellite dishes require prior written approval.
- Assessments & HOA: All lot owners (except developer) must pay annual and special assessments. Annual assessments can be increased up to 10% per year by the board; larger increases require a 2/3 vote. Special assessments for capital improvements also require 2/3 vote. Assessments are a lien on the lot, with 14% annual interest on delinquencies. A working capital reserve equal to two months' assessment is due at closing.
- Insurance: Each owner must maintain casualty and liability insurance on their unit and exterior. The HOA must carry liability insurance of at least $1,000,000 on common areas and property insurance as determined by the board. Premiums are a common expense assessed equally to owners.
