Land's End Subdivision is a standard single-family HOA in Wilmington, NC. These restrictive covenants run with the land and bind all lot owners. The HOA maintains common areas and enforces rules on architecture, use, and assessments.
- Membership & voting: Each lot owner is a member of the HOA with one vote per lot. Only one vote per lot, even if multiple owners.
- Assessments & fees: Annual assessments are set by the Board and cannot increase more than 50% over the prior year without a vote of half the members. Special assessments for capital improvements require a 2/3 vote. A $100 initial setup fee is due at closing. Assessments are a lien on the lot and personal obligation of the owner.
- Architectural review: No building, fence, sign, or exterior alteration may begin without written approval from the Developer (or later the HOA's Architectural Review Committee). Plans are deemed approved if no response within 30 days. Construction must be completed within 12 months.
- Use restrictions: Lots are for residential use only. Minimum home size: 1,800 sq ft (one story) or 2,200 sq ft (two story). No subdivision of lots below 10,000 sq ft. No commercial activity, but home offices not open to the public are allowed. No outside antennas or satellite dishes without approval. Garbage receptacles must be recessed or screened.
- Pets: Only dogs, cats, or household pets kept indoors are allowed. No breeding or raising animals.
- Parking & vehicles: Each lot must provide off-street parking. No storing vehicles, boats, trailers on streets or common areas.
- Common area use: Owners have an easement to use common areas, subject to HOA rules. The HOA can suspend use for unpaid assessments or rule violations (up to 90 days).
- Amendment & duration: Covenants run for 20 years from recording, then auto-renew for 10-year periods. Amendment requires 90% lot owner approval in first 20 years, then 75% thereafter.
