Oleander Oaks Condominiums is a condominium community in Wilmington, NC — you own your individual unit and share ownership of the building's common elements, which the association maintains. The community is restricted to office and commercial use (per zoning), not residential. The declaration also reserves development rights for the builder to add up to 48 units.
- What you own & maintain: You own the interior of your unit (within the unfinished surfaces of walls, floors, and ceilings), including certain mechanicals serving only your unit. The association maintains all common elements, and you maintain your unit and certain limited common elements (like stoops, exterior doors/windows, and HVAC units assigned to your unit).
- Use restrictions (commercial only): Each unit is restricted to office use and any other commercial activity permitted under applicable zoning. No residential use is allowed. Prohibited uses include health spas, dance/karate studios, skating rinks, bowling alleys, and establishments selling alcohol for on-premises consumption without board consent.
- Leasing & rentals: Units may be leased subject to any applicable rules and regulations. All leases must include a provision that the tenant will recognize and attorn to the association as landlord for enforcement purposes. Time-sharing plans are prohibited.
- Pets: The declaration does not address pets; any restrictions would be in the rules and regulations.
- Architectural review: No structural additions, alterations, or improvements may be made without prior written consent of the executive board. Changes to the exterior appearance of a unit or common elements also require permission. The board must respond to a written request within 60 days after notice and hearing.
