College Park Subdivision is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants recorded in 1958. These covenants run with the land and bind all homeowners in Section 'C' of the subdivision.
- Residential use & building type: Lots may be used only for residential purposes. Only one detached single-family dwelling (max 2.5 stories) plus a one- or two-car garage may be built per lot.
- Minimum living area: Each dwelling must have at least 1,200 square feet of interior living area, excluding storage rooms, carports, porches, and garages.
- Setbacks & lot lines: Buildings must be set back at least 75 feet from the front street line and at least 10% of the lot width from adjacent property lines.
- Architectural review: Building design must be approved by the developer or successor. The reviewer has 10 days to approve or disapprove plans; if no response within 10 days, approval is not required, provided the design is in harmony with existing structures.
- Prohibited uses & structures: No trailer, basement, tent, shack, garage, barn, or other outbuilding may be used as a residence. No noxious or offensive trade or activity is allowed. No outdoor toilets are permitted.
- Signs: No signs or billboards are allowed except 'For Rent' or 'For Sale' signs.
- Sewage: Until municipal sewer is available, sewage must be handled by septic tanks approved by the North Carolina State Board of Health.
- Duration & amendment: These covenants run until December 1, 1983, and automatically renew for successive 10-year periods unless a majority of lot owners vote to change them. Invalidating one covenant does not affect the others.
