What Kimberly Estates's governing documents say
Kimberly Estates is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1975. These covenants run with the land and apply to all current and future lot owners.
- Residential use only: All lots are restricted to residential use. No business, trade, professional office, fraternity, rooming house, boarding house, antique shop, or gift shop is allowed. No noxious or offensive activities, and no storage of trade materials or inventories.
- Building & structure rules: Only one detached single-family dwelling (max 2.5 stories) plus a private garage (max 3 cars) and incidental outbuildings (including servant's quarters) are permitted. Minimum heated floor area: 950 sq ft (excluding garage, carport, porch). No trailer, mobile home, basement, tent, shack, garage, barn, or temporary structure may be used as a residence.
- Setbacks & lot lines: Front setback: 30 ft. Side setback: 10% of average lot width. Rear setback: 25 ft. On corner lots, the shorter street frontage is considered the front. No unattached garage allowed. Outbuildings, playhouses, dog houses must be at least 50 ft from front lot line, 10% of average width from side lot line, and 10 ft from rear lot line.
- Easements & drainage: Utility and drainage easements exist as shown on the plat and over the rear 10 ft of each lot. No structures, plantings, or materials that interfere with utilities or drainage are allowed. No fence within 10 ft of rear lot line. Lot owners maintain the easement area except for public/utility improvements. Drainage easements may be relocated by lot owners if it doesn't adversely affect other lots.
- Pets & animals: Only household pets are allowed. No commercial dog kennels. No other domesticated animals are permitted.
- Fences & signs: Fences cannot exceed 48 inches in height and cannot be placed nearer the street than the front of the building. Only one sign (max 5 sq ft) advertising the property for sale or rent is allowed, plus builder signs during construction/sales.
- Architectural review: The design of all buildings must be approved by the original developers, their attorney-in-fact, or a committee they appoint.
- Sewage disposal: Until a public sewer system is available, septic tanks approved by the NC State Board of Health are required. Once sewer is available, connection is mandatory.
