Durango Place Townhomes is a planned community of attached townhomes in Wilmington, NC, governed by a homeowners' association (HOA). Each owner holds fee simple title to a Lot and shares ownership of Common Elements (including a stormwater pond) and Limited Common Elements (private backyard areas). The HOA maintains most exteriors and common areas, funded by assessments on all Lots.
- What you own & maintain: You own your Lot and the townhome structure, but the HOA maintains the exterior siding, roofs, gutters, and landscaping within your Lot (except windows, doors, decks, patios, and HVAC equipment, which you maintain). You also have exclusive use of a Limited Common Element (backyard) adjoining your Lot, which the HOA maintains unless damage is caused by your negligence.
- Architectural review: Any exterior addition, alteration, or improvement (including painting) requires prior written approval from the Declarant or, after Declarant control ends, the HOA Board or an Architectural Control Committee. Approval may be based on aesthetic grounds. If no decision is made within 30 days, approval is deemed given.
- Parking & vehicles: Parking is not allowed on Lots. Each Lot is assigned exclusive parking spaces in the Common Elements. No trailers, campers, boats, RVs, or vehicles over one ton may be parked on the property except temporarily in designated areas. Inoperable or unregistered vehicles are prohibited and may be towed.
- Pets: Only house pets are permitted, and they must not be a danger or nuisance. Owners must follow HOA rules and local leash laws. Pets may not run freely through the property.
- Leasing & rentals: Owners may lease their Lot, but must provide tenants with a copy of the Declaration. No minimum lease term is specified in this document.
- Use restrictions: Lots are for single-family residential use only. No commercial or industrial activity, no offensive trades, and no noxious or annoying activities are allowed. Temporary structures, clotheslines, and burning of trash are prohibited. Signs are restricted except for real estate signs and U.S. or North Carolina flags (max 4x6 feet).
- Assessments & fees: The HOA levies annual assessments, special assessments (requiring 2/3 owner approval), and individual Lot assessments. Unpaid assessments become a lien on the Lot after 30 days and may bear interest up to 18% per year, plus late fees (greater of $20/month or 10% of unpaid installment). The HOA may also suspend privileges (except access) for nonpayment.
- Insurance: The HOA carries an all-risk hazard policy covering Common Elements and townhome structures (including original fixtures) at full replacement cost. The deductible for damage to a townhome is paid by the affected owner. Owners should consider separate HO-6 policies for personal contents, improvements, and liability.
