Walnut Hills is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants that run with the land and bind all lot owners. These rules cover what you can build, how you can use your property, and basic maintenance standards.
- Residential use only: Lots may be used only for residential purposes. No commercial trade, noxious activity, or nuisance is allowed. Unsightly junk cars and poorly maintained yards can be cleaned up by the developer at the owner's expense.
- Building & design standards: Only one detached single-family dwelling (max 2 stories) and a private garage for up to 2 cars are allowed. Minimum heated living area is 850 sq ft (excluding porches, garage, carport). Plans must be approved by Apple Valley, Inc. (or successor); if no response within 20 days, plans are deemed approved if in general conformity.
- Setbacks & lot coverage: Buildings must be at least 25 ft from the front street line and 10 ft from side lot lines. Maximum impervious cover (foundation, driveways, accessory buildings) is 3,500 sq ft per lot. Eave overhangs up to 3 ft and uncovered stoops/steps are allowed within setbacks.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock. Dogs, cats, and other household pets are allowed but not for commercial purposes, and must not become a nuisance.
- Fences & signs: Fences or obstructions over 4 ft high cannot extend nearer the street than the front corners of the house. Signs are limited to 'For Rent' or 'For Sale' signs no larger than 5 sq ft.
- Temporary structures & satellite dishes: No temporary structures, trailers, mobile homes, tents, shacks, garage apartments, barns, or outbuildings are allowed. Satellite dishes are prohibited.
- Maintenance & debris: All buildings must be kept in good repair. If destroyed by fire or casualty, debris must be cleared within 90 days. No dumping of rubbish or waste except in sanitary containers.
- Duration & amendments: These restrictions remain in effect until December 31, 2020, and automatically renew for successive 10-year periods unless terminated by 75% of lot owners. Amendments require written consent of Apple Valley, Inc. (or successor) and owners of at least 60% of lots.
