- Ownership structure & use rights: You buy a 1/10th undivided interest in a townhouse lot and a 1/20th interest in common area, giving you the right to occupy a residence for five weeks per year (Use Period). Use weeks are assigned by a rotating number system (1–10) and can be exchanged privately among owners.
- Leasing & rentals: Owners may rent out all or part of their Use Period, but the rental must not interfere with other owners' rights. The number of occupants is limited by the Rules and Regulations.
- Pets: No animals, livestock, birds, fish, poultry, dogs, cats, or household pets of any kind are allowed in or on the property.
- Fees & assessments: Each owner pays an annual Maintenance Fee (initially $1,135 per Co-Ownership Interest), payable in installments. Special assessments may be levied if funds are inadequate. Personal charges (e.g., damage, long-distance calls) are billed separately. Fees can be increased or decreased by a two-thirds vote of owners.
- Alterations & maintenance: No alterations to the residence, common furnishings, or property without prior written consent of the Managing Agent. Painting, redecorating, landscaping changes, and antenna installation are prohibited without approval. The Managing Agent handles all maintenance and repairs.
- Transfer & sale restrictions: Owners must first offer their Co-Ownership Interest to the Declarant (right of first refusal for 15 days). If Declarant declines, the owner may sell within 90 days on terms no more favorable. Transfers must comply with the declaration and Occupancy Agreement; partial transfers are prohibited.
- Enforcement & penalties: The Managing Agent can suspend an owner's occupancy and voting rights for violations, including non-payment. Unpaid assessments become a lien on the interest. Overstaying a Use Period results in liquidated damages of 200% of fair rental value per day, plus costs.
