What Joshua's Landing's governing documents say
Joshua's Landing is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners and residents. It covers permitted uses, architectural controls, maintenance obligations, assessments, and community amenities like boat slips and common areas.
- Residential use & lot rules: Each lot is for single-family residential use only. Only one main dwelling per lot, with a minimum of 2,200 sq ft and a maximum of 4,000 sq ft of heated floor space (exclusive of garage, covered walks, and porches). Guest quarters may be allowed with association approval. No temporary structures, trailers, tents, or barns are permitted.
- Architectural review: All building plans, exterior colors, materials, site grading, landscaping, and any alterations must be approved in writing by the Architectural Review Committee (ARC) before construction. The ARC has sole discretion to approve or deny based on any grounds, including aesthetics and environmental considerations.
- Assessments & fees: The association levies annual and special assessments on each lot. Annual assessments are due January 1 and become delinquent February 1; special assessments are due as set by the association. Unpaid assessments accrue interest at 1.5% per month and become a lien on the lot. Lots with boat slips also pay separate assessments for dock and canal maintenance.
- Boat slips & common area: Each lot is intended to have at least one boat slip appurtenant to it, subject to governmental approval. Boat slips cannot be sold separately from the lot. The association may assign shared slips to owners without a slip. Common area 'Parcel A' is for all lot owners' use, subject to association rules.
- Parking & driveways: Each lot must provide off-street parking for three automobiles before occupancy. Only one driveway per lot, not exceeding 16 feet in width. All parking areas and driveways must be paved and screened from view. Parking areas count toward the maximum built-upon area of 3,252 sq ft per lot.
- Landscaping & vegetation: No trees, bushes, or other vegetation may be removed, planted, or installed without prior written approval from the association based on a submitted landscaping plan. Native growth is protected. Clotheslines must not be visible from streets, common areas, or Hewlett's Creek.
- Leasing & rentals: The document does not address leasing or rental restrictions. Prospective buyers and renters should check with the association for any separate rental policies.
