Birkdale at Landfall is a single-family home HOA in Wilmington, NC, part of the larger Landfall master-planned community. The rules bind all lot owners and are enforced by the Birkdale Homeowners' Association and the Landfall Council of Associations.
- What you own & maintain: You own your lot and home. The Association handles landscaping and irrigation of all lots as a common expense, but you are responsible for exterior maintenance of your dwelling.
- Assessments & fees: Annual assessments are set by the Board, with a maximum increase of 20% per year without a 2/3 member vote. Special assessments for capital improvements also require a 2/3 vote. Assessments are uniform per lot and may be paid monthly, quarterly, or annually.
- Leasing & rentals: Leases must be for at least six months, and you cannot lease less than the entire home. Transient or hotel use is prohibited. Leases must be in writing and subject to the governing documents.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be kept in the home or in an area approved by the Architectural Control Committee.
- Parking & vehicles: Off-street parking must be provided on your lot. No parking on streets or common areas. Trucks, boats, trailers, and commercial vehicles must be stored inside an enclosed garage.
- Architectural review: The Architectural Control Committee of the Landfall Council must approve any changes to exteriors, signs, or structures. No building under 2,000 square feet (excluding porches, decks, garages) is allowed. Impervious surface on a lot cannot exceed 55%.
- Use restrictions: All lots and homes are for single-family residential use only. No business, trade, or profession is allowed, except Declarant may use up to four homes for sales/display and Landfall Associates may use up to two homes for overnight housing for prospective buyers.
- Master association: Birkdale is part of The Landfall Council of Associations, which imposes additional Shared Common Expense assessments. Council rules prevail over Association rules in case of conflict.
