Windswept Villas is a standard single-family home HOA in Wilmington, NC, governed by the North Carolina Planned Community Act. This declaration applies to all lot owners in the subdivision and covers use restrictions, architectural control, assessments, and stormwater management.
- What you own & maintain: You own your lot and the home on it. You must maintain the exterior of all buildings and landscaping, and the association maintains common areas including private roads, ponds, and recreation areas.
- Architectural review: All exterior changes (houses, fences, driveways, landscaping) must be approved by the Declarant or, after Declarant control ends, by an Architectural Review Committee. Minimum heated square footage for a house is 1,000 sq ft.
- Leasing & rentals: No lease for a term of less than six months is allowed.
- Pets: Only domestic dogs, cats, or other household pets are allowed, not kept for commercial purposes, and not in numbers that create a nuisance.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars. Boats, RVs, and similar vehicles may only be parked on approved driveways or pads. Inoperable vehicles are prohibited and may be towed.
- Assessments & fees: Annual assessments are set by the board (initial $300/year, $25/month or $75/quarter). A one-time working capital assessment of $100 is due at purchase. Special assessments require 2/3 member vote. Unpaid assessments become a lien on the property.
- Stormwater & drainage: The association is responsible for stormwater facilities. No more than 2,500 sq ft of impervious surface per lot. Swales and drainage easements cannot be altered without approval.
