Fairhaven at Lytham is a single-family home community in Wilmington, NC, governed by a homeowners' association (HOA). It is part of the larger Landfall community, so residents also pay dues to the Landfall Subdivision II Owners Association. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners.
- What you own & maintain: You own your lot and the house on it. The HOA maintains all landscaping on your lot (except within fenced courtyards and enclosed pool areas) and the common areas. You are responsible for maintaining your house, garage, driveway, walkways, pools, patios, and other structures.
- Architectural review: Any exterior changes or new construction (including landscaping) must be approved by the Architectural Control Committee (ACC) or the developer during the developer control period. The ACC can deny plans based on aesthetics or increased maintenance costs. Fenced courtyards and enclosed pool areas allow some landscaping without approval.
- Use restrictions: Lots are for single-family residential use only. Home offices are allowed if no non-owner works there. No boats, campers, trailers, RVs, or inoperable vehicles may be stored on lots or streets. Only standard passenger vehicles, passenger vans, and pick-up trucks may be parked. Garage doors must not be left open overnight.
- Pets: A reasonable and traditional number of dogs, cats, or other household pets is allowed, but they must be leashed and controlled, and owners must clean up waste. No commercial breeding or nuisance animals are permitted.
