Landfall Highlands is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (Landfall Highlands Owners Association) and also subject to a master association (Pembroke Jones Park Owners Association). The rules apply to all lot owners and are designed to protect property values and maintain a residential character.
- What you own & maintain: You own your lot and the house on it. The association owns and maintains common elements (e.g., drives, walkways, parking, recreational facilities) and may also maintain limited common elements that serve only a few lots.
- Membership & voting: Every lot owner is a member of the association. Each lot gets one vote (except the developer, who gets three votes per lot until certain conditions are met). Voting rights can be suspended for unpaid assessments or rule violations.
- Assessments & fees: The board sets annual assessments at any amount in its sole discretion. Special assessments for capital improvements require a 2/3 vote of members. - Parking & vehicles: Boats, trailers, campers, motorhomes, trucks, and tractors may not be parked on lots, common elements, or streets except inside an enclosed garage or in a designated storage area. Delivery and maintenance vehicles may not park overnight.
- Signs: No signs, placards, or billboards are allowed except as permitted by the association or required by law. 'For Sale' or 'For Rent' signs may be placed on lots, and the developer may erect sales signs during development.
- Leasing & rentals: The document does not specify minimum lease terms or restrictions on renting. Owners may delegate use of common elements to tenants who reside on the property.
