Windswept II Villas is a two-unit condominium (villa) community in Wrightsville Beach, NC. Each owner owns their unit and an undivided one-half interest in the common areas. The association maintains common elements and carries master insurance, funded by assessments on each unit.
- What you own & maintain: You own your unit (interior surfaces of perimeter walls, two-story ceiling, and land beneath) and an undivided one-half interest in general common areas. You are responsible for all maintenance and repairs inside your unit, including structural and non-structural items. The association maintains all common elements (roofs, foundations, land, etc.) as a common expense.
- Leasing & rentals: You may rent your entire villa, but you cannot rent individual rooms. Leases must be for the whole unit. No minimum lease term is stated in this document.
- Use restrictions: Each villa may be occupied only by a family for residential purposes. No villa may be divided or subdivided. No use that is a source of annoyance to residents or that interferes with peaceful possession is permitted. All valid laws and zoning ordinances must be observed.
- Right of first refusal: If you offer to sell your villa, you must first give the other villa owner a right of first refusal to purchase at the same price and terms as any bona fide offer. That right expires 30 days from the date of offer.
- Assessments & liens: The Board of Managers sets annual common charges based on a budget. Unpaid assessments accrue interest at the legal rate and create a lien on your villa, which can be foreclosed. The association can also seek a money judgment.
- Alterations & improvements: No structural addition, alteration, or improvement may be made to your unit without prior written consent of the Board of Managers. The Board must respond within 30 days; failure to do so constitutes consent. The Board is not liable for claims arising from such work.
- Insurance: The association must maintain property insurance on the building at 100% replacement cost, plus liability insurance. You may insure your personal property separately, but your coverage cannot reduce the association's recovery.
