Windswept III Villas is a two-unit condominium community in Wrightsville Beach, NC — you own your individual villa (unit) and an undivided one-half interest in the common elements. The association maintains the common areas and carries master insurance, funded by per-unit assessments. This document is the original 1985 Declaration and By-Laws; it may be supplemented by later amendments or rules.
- What you own & maintain: You own your villa's interior (perimeter walls inward) and have exclusive use of designated limited common areas (carport, storage). The association maintains all common elements (roofs, foundations, land, utilities to outlets, etc.) and carries master property and liability insurance. You are responsible for all maintenance and repairs inside your villa, including structural items.
- Leasing & rentals: You may rent your entire villa, but no portion of a villa (e.g., a single room) may be rented. Leases must be for the whole unit. No minimum lease term is stated in this document.
- Use restrictions: Villas are for residential use only, by a family. No business or commercial use is allowed. No use that is a source of annoyance or increases insurance rates is permitted. All laws and zoning must be observed.
- Right of first refusal: If you offer your villa for sale, you must first give the other unit owner a 30-day right of first refusal to purchase at the same price as any bona fide offer you receive.
- Assessments & fees: The Board of Managers sets annual common charges based on a budget. Each unit owner pays one-half of the total. Unpaid assessments accrue interest at the legal rate, plus collection costs and attorney's fees, and create a lien on the unit that can be foreclosed.
- Alterations & improvements: No structural addition, alteration, or improvement may be made to your villa without prior written consent of the Board of Managers. The Board must respond within 30 days; failure to respond constitutes consent. The Board is not liable for contractor claims or injuries related to such work.
- Insurance & damage: The association must insure the building at 100% replacement cost for fire, flood, and other hazards, plus liability coverage. If the building is more than 3/4 destroyed and all owners agree not to rebuild, the property is owned as tenants in common and may be partitioned.
- Governance & voting: The association is governed by a two-member Board of Managers (one per unit). Each unit owner has one vote. Meetings require 100% attendance for a quorum. Deadlocks are resolved by arbitration under North Carolina law.
