Belmar Forest is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) that run with the land. These rules apply to all lot owners and are designed to maintain the residential character and appearance of the neighborhood.
- Residential use & structures: Lots are for single-family residential use only. No more than one dwelling per lot, minimum 1,650 sq ft heated living area, and no temporary structures or trailers as dwellings. Accessory buildings (e.g., garages) must be compatible and cannot be built before the main house or used as residences. No structure over two stories.
- Impervious area limit: No more than 4,371 square feet of any lot (including street right-of-way) may be covered by structures or paved surfaces (walkways, driveways, patios) to comply with stormwater regulations.
- Parking & vehicles: At least two off-street parking spaces per dwelling. No inoperable, junked, or unregistered vehicles. No buses, vans, school buses, or vehicles larger than 3/4 ton. Boats must be stored out of street view. No commercial vehicles.
- Architectural review & construction: All construction requires prior written approval from the Developer (or successor) for site plan, design, materials, and location. Exterior materials must be wood, brick, stone, stucco, or approved siding; concrete block not allowed unless covered. Roof pitch minimum 6/12, shingles earth tones. Construction must be completed within 12 months or a $50/day penalty applies.
- Lot maintenance & nuisances: Owners must keep lots clean, mowed, and free of debris. No noxious activities, hazardous materials, or nuisances. No salvaged materials, junk vehicles, or more than two cords of visible firewood. Clotheslines not visible from street. Exterior lights must be clear, white, or yellow bug bulbs.
- Pets & animals: No fowl, livestock, or farm animals. Customary household pets allowed but not in numbers constituting a nuisance or for commercial purposes. Pets must be contained on owner's lot and kept clean. Subject to local leash laws.
- Fences, signs & antennas: Chain link fences prohibited; other fences require Developer approval. No fence or hedge nearer front lot line than rear corners of house. No advertising signs except one 5 sq ft 'for sale' sign. No satellite dishes or outside antennas without permission.
- Homeowners' association & assessments: The Belmar Forest Owners' Association is a non-profit that owns and maintains stormwater controls. All lot owners are members, must pay assessments, and are subject to the association's bylaws and rules.
