What Saratoga Place's governing documents say
Saratoga Place is a single-family home subdivision in Wilmington, NC. These restrictions apply only to Section 1, Phase 1, and are enforced by the developer, lot owners, or government authorities. The rules cover what you can build, how you can use your lot, and what vehicles and pets are allowed.
- Allowed use & structures: Lots are for single-family homes only. Each lot may have one detached single-family dwelling and a garage for up to two cars. No garage apartments, trailers, mobile homes, tents, or barns are allowed. Minimum dwelling size is 1,000 square feet (excluding porches, decks, garages, etc.).
- Setbacks & impervious coverage: Buildings must be at least 25 feet from the front street line and 8 feet from side/rear lot lines (5 feet for detached garages or approved storage buildings). No more than 2,400 square feet of any lot may be covered by impervious surfaces (asphalt, concrete, brick, etc.), not including wood decking or pool water surface.
- Architectural review: Building plans must be approved by the developer. If no response is received within 20 days of submission, plans are deemed approved as long as they are in general conformity with other improvements in the subdivision.
- Pets: Only domesticated dogs, cats, or other household pets are allowed. No commercial breeding or keeping of animals that become a nuisance.
- Vehicles & parking: Boats, campers, trailers, motor homes, mobile homes, trucks rated over 3/4 ton, and similar vehicles cannot remain on any lot unless stored in an enclosed area not visible from the street, or with written permission from the developer.
- Fences & signs: Fences must be set back at least to the rear corners of the house, no taller than 6 feet, and made of wood or chain link. Ornamental fencing requires developer approval. Signs are limited to 'For Sale' or 'For Rent' signs no larger than 6 square feet.
- Yard maintenance & nuisances: Yards must be maintained; the developer may clean neglected yards at the owner's expense. No dumping of trash or junk cars. Front yards must be sodded (minimum 5 pallets). No mass clearing of trees without developer consent.
- Stormwater & drainage: Owners must maintain drainage easements, prevent erosion, and not place structures or plantings that interfere with drainage. Berms and outfall controls are required for lots bordering drainage areas. Lot line swales must not be piped or filled.
