Gordon Woods, Section 3 is a single-family home subdivision in Wilmington, NC. These restrictions apply only to Section 3 and are enforced by lot owners, not an HOA. The developer had amendment power until 2001; after that, amendments require 60% of lot owners.
- Use & structures: Lots are for single-family use only. Only one detached single-family dwelling and a garage for up to two cars are allowed. No garage apartments, trailers, mobile homes, tents, or shacks. Minimum dwelling size is 1,000 square feet (exterior foundation, excluding porches, garages, etc.).
- Setbacks & easements: Buildings must be at least 25 feet from the front street line, 10 feet from side/rear lot lines (5 feet for detached garages or approved storage). Eaves may overhang up to 3 feet. The developer reserved 10-foot front and 5-foot side/rear easements for utilities and drainage.
- Architectural review: Building plans must be approved by the developer (or successor). If no response within 20 days of submission, plans are deemed approved as long as they conform generally to other structures in the subdivision.
- Pets: Only domesticated dogs, cats, or other household pets are allowed. No commercial breeding or keeping pets in numbers that become a nuisance.
- Vehicles & parking: Unsightly, inoperative junk cars cannot be maintained on any lot or street. Driveways must be paved with asphalt or concrete and piped with driveway pipes at least 20 feet long.
- Fences & signs: Fences must be wood or chain link and cannot be placed nearer the front street line than the rear corners of the house. Ornamental fencing requires written approval. Signs are limited to 'For Rent' or 'For Sale' signs no larger than 6 square feet.
- Maintenance & nuisances: Owners must maintain their lots and buildings. No dumping of rubbish; trash must be in sanitary containers. Yards must be landscaped and kept neat. No noxious or commercial activities. The developer may clean unmaintained yards at the owner's expense.
- Utilities & drainage: Water for human consumption must come from the community water system. Private wells for irrigation require utility company consent. Sewage must connect to the community system. Owners maintain drainage easements on their lots.
