Pin Oaks One Townhouses is a townhome community in Wilmington, NC, governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that run with the land. The rules apply to all owners, tenants, and occupants, and are enforced by the Pin Oaks One Townhouses Owners Association.
- Residential use only: All lots must be used for residential purposes only; no business, manufacturing, commercial, or professional use is allowed.
- Architectural review & design control: The Association must approve the location, design, and construction materials of any building or structure, as well as any exterior color changes. Approval is deemed given if the Association does not respond within 10 days of a written request.
- Maintenance responsibilities: Owners must maintain their lot and exterior of their unit in good condition. The Association paints exteriors as needed and maintains walkways, parking areas, common areas, and front/side yard areas not fenced. Owners are responsible for roof repair/replacement (jointly if shared roof).
- Pets: No more than three household pets per lot. Pets must be confined within a fenced area or on a leash when outside. Owners must clean up pet debris; costs of removal by others may be assessed against the owner.
- Parking & vehicles: Vehicles must be parked in driveways only; no parking on lawns, roadways, or common areas. No more than two vehicles per residence without written approval. Inoperable vehicles, those without current registration/license/insurance, and tractor-trailers are prohibited. Boats, RVs, and similar vehicles must be parked in the backyard out of street view. Vehicle repairs must be completed within one day.
- Yard maintenance & personal property: Owners must keep their lot neat and tidy. Trash receptacles, lawn furniture, toys, bicycles, grills, and similar items must be stored within the fenced area. No statues, sculptures, yard decorations, or artificial wildlife are allowed. Clotheslines require Association approval and must be screened from public view.
- Assessments & fees: Annual assessments are set by the Board and may be increased up to 10% per year without member vote; larger increases require a 2/3 vote. Special assessments for capital improvements also require 2/3 approval. Assessments are due quarterly; unpaid amounts accrue 14% annual interest and may become a lien on the lot. A working capital reserve equal to two months' estimated assessment is due at closing.
- Amendments & term: The restrictions run for 20 years from March 1999, automatically renewing for successive 10-year periods unless a majority of lot owners agree to change them. Amendments require a written document signed by owners of at least 2/3 of the lots.
