What Windsor Estates's governing documents say
Windsor Estates is a standard single-family home subdivision in Wilmington, NC, governed by restrictive covenants that run with the land. These rules apply to all lot owners and residents, covering residential use, building size and design, setbacks, and an HOA for private road and common area maintenance.
- Residential use only: Lots may be used only for residential purposes. No commercial trade or activity is allowed, and no nuisance or junk cars may be maintained.
- Dwelling & size requirements: Only one detached single-family dwelling (max two stories) and a private garage (max three cars, no living quarters) per lot. Minimum heated floor area is 2,000 square feet (excluding porches, garage, carport).
- Architectural review: Plans for all dwellings and structures must be approved by the developer (or their nominee). If no response within 10 days of submission, plans are deemed approved if in general conformity with other homes.
- Setbacks & fences: Buildings must be at least 60 feet from the front lot line and 15 feet from any side street line. Fences cannot extend closer to the street than the front setback line of the main dwelling.
- Homeowners Association & assessments: A mandatory HOA composed of all lot owners maintains private roads, plazas, and entrance signs. Annual and special assessments require a two-thirds vote, are a continuing lien on the property, and bear 10% interest if unpaid after 30 days.
