Holly Glen Estates is a standard single-family homeowners association (HOA) in Wilmington, NC. This document is the full Declaration of Covenants, Conditions and Restrictions (CC&Rs) that binds all lot owners. It covers property rights, maintenance responsibilities, assessments, and use restrictions for the 115-lot subdivision.
- What you own & maintain: You own your lot and dwelling unit. The Association maintains common areas (private roads, landscaping, recreational facilities). You must maintain your lot and unit, including mowing, landscaping, and keeping it free of unsightly objects. The Association may also provide lawncare for lots and charge you.
- Assessments & fees: All lot owners pay monthly Regular Assessments for common expenses. A Working Capital Assessment equal to two months' Regular Assessment is due at purchase. Special Assessments require a 2/3 member vote (except for sewer/stormwater maintenance). Late payments incur a $20 or 20% late charge and 10% annual interest. Assessments are a lien on the lot.
- Leasing & rentals: The document does not restrict leasing terms or require approval. Tenants have a non-transferable right to use common areas. Owners are responsible for their tenants' compliance with rules.
