Holly Downs is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). The rules apply to all lot owners, residents, and guests, and are designed to protect property values and maintain a uniform residential character.
- What you own & maintain: You own your lot and the single-family dwelling on it. The HOA maintains common areas, including planting easements, the entrance signage, street islands, the stormwater drainage system (except lines within individual lots), and the irrigation system for planting areas. Lot owners are responsible for maintaining the portion of the boundary fence along their lot (lots 8, 9, 17, 18).
- Architectural review: All exterior construction, additions, alterations (including painting), fences, and other structures require prior written approval from the Declarant (developer) or, after all lots are sold, the HOA Board or an architectural committee. Temporary structures, trailers, and recreational vehicles (boats, campers, etc.) are prohibited without written consent. No inoperable or unregistered vehicles, and no tractor-trailers. Vehicle repairs must be done in garages not visible from the street. All window coverings visible from outside must be white or neutral. Exterior lights must be clear, white, or non-frost. No satellite dishes or outside antennas without permission. Signs are prohibited except for a single 'For Sale' sign conforming to county ordinance (developer may display signs on unsold lots).
- Pets: Dogs, cats, or other household pets are allowed, but not for commercial purposes. Pets must be leashed at all times and not allowed to run free.
- Parking & vehicles: Each lot must provide off-street parking for at least two passenger automobiles, with driveways and parking areas made of concrete, brick, asphalt, or turfstone. No inoperable or unregistered vehicles, and no tractor-trailers. Vehicle repairs must be done in garages not visible from the street.
- Assessments & fees: Annual assessments are set by the HOA Board, with a maximum annual increase of 5% without member vote (or up to $300 per lot initially). Special assessments for capital improvements require a two-thirds vote of members. Assessments are a lien on the property and a personal obligation of the owner at the time they fall due. The HOA also levies insurance assessments for common area insurance premiums.
