Wood Acres is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1955. These covenants run with the land and apply to all lot owners, their heirs, and assigns.
- Residential use only: Lots may be used only for residential purposes. Only one detached single-family dwelling (max 2.5 stories) and a private garage for up to two cars are permitted.
- Minimum dwelling size & cost: Dwellings must cost at least $8,000 (based on 1955 cost levels). Minimum ground floor area is 1,000 sq ft for one-story homes, or 800 sq ft for homes with more than one story (excluding open porches and garages).
- Setbacks & lot requirements: Buildings must be at least 50 ft from the front lot line, 25 ft from side street lines, and 10 ft from interior lot lines (except garages 100+ ft from setback). Minimum lot width is 75 ft at the setback line; minimum lot area is 20,000 sq ft.
- Nuisance & temporary structures: No noxious or offensive activity is allowed. Temporary structures, trailers, tents, shacks, garages, barns, or outbuildings may not be used as residences.
- Duration & amendment: Covenants run for 25 years from recording (1955), then auto-renew for successive 10-year periods unless a majority of lot owners agree to change them.
- Enforcement: Violations may be enforced by legal proceedings (law or equity) to restrain violations or recover damages.
- Easements: Easements for drainage facilities are reserved as shown on the plat and over the rear 5 ft of each lot. An additional easement is granted to Carolina Power & Light Co. for power lines.
