Parkside at Mayfaire is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). This document is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies to all lot owners in Section One. It sets rules for property use, architectural standards, assessments, and maintenance obligations.
- What you own & maintain: You own your lot and the house on it. You must maintain your lot free of weeds and debris, and keep the structure in good repair. The HOA maintains common areas (parks, ponds, streets, and the private sewage system) and can enter your lot for maintenance if needed.
- Architectural review: Any exterior changes or new construction must be approved by the Architectural Control Committee. The committee considers aesthetics and harmony with the neighborhood. Approval expires if construction doesn't start within 6 months or finish within 1 year.
- Assessments & fees: All lot owners pay annual assessments to cover common area maintenance, insurance, and the private sewage system. Special assessments may be levied for capital improvements. A working capital fee equal to 2 months' assessments is due at purchase from the developer. Unpaid assessments become a lien on the property.
- Leasing & rentals: Leases must be for at least 3 consecutive months. No short-term rentals.
- Pets: Dogs, cats, and other household pets are allowed but must be leashed and not become a nuisance. Owners must clean up pet waste. No commercial breeding.
- Parking & vehicles: Only standard passenger vehicles, passenger vans, and pick-up trucks may be parked. Boats and trailers must be stored behind the house and screened. Inoperable vehicles are prohibited. No vehicle repairs visible from the street.
- Use restrictions: Lots are for single-family residential use only. No temporary structures as residences (except approved garage apartments up to 750 sq ft). No signs without approval (except one builder sign before occupancy). Christmas decorations only Nov 20–Jan 7. No subdivision of lots without consent.
- Private sewage system: The community has a private sanitary sewage disposal system maintained by the HOA. Owners are responsible for the portion on their lot. The HOA must prioritize its maintenance and can levy unlimited special assessments for repairs.
