- Assessments & fees: Annual assessments are levied per lot, initially capped at $75/month. They can increase up to 5% per year without a vote, or more with a two-thirds vote. Special assessments for capital improvements also require a two-thirds vote. Assessments are a lien on the property and a personal obligation of the owner.
- Use restrictions: Lots are for single-family residential use only. No mobile homes, tents, or temporary structures. No noxious activities. Only domesticated household pets (no farm animals). No junk cars or large trucks; recreational vehicles must be stored under the house or in approved facilities.
- Architectural review: Any new construction, fence, wall, or exterior alteration requires written approval from the Board or an architectural committee. Plans must be submitted; if no decision within 60 days, approval is deemed given. While the Declarant owns any lot, it controls the architectural guidelines.
- Leasing & rentals: Owners may lease their lot, and tenants may use common areas. Leases must be for at least six months. The owner remains responsible for assessments.
- Common area use: All owners have an easement to use common areas (boat slips, swimming pool, etc.). Use can be suspended for non-payment of assessments or for rule violations (up to 60 days). Common area rights cannot be sold separately from a lot.
- Insurance: Each owner must maintain casualty and liability insurance on their lot and improvements. If an owner fails to insure, the association may obtain insurance and charge the owner, creating a lien.
