Jacobs Bluff is a small, single-family home planned community in Wilmington, NC, with only three lots. Owners own their lot and home, and share common elements including a private street, a pier, and a proposed community boating facility with boat slips assigned to each lot. The homeowners' association manages the common areas and enforces the rules.
- What you own & maintain: You own your lot and the single-family home on it. You must maintain your lot and structures, keep them neat and free of weeds or debris. The association maintains common elements like the private street (Enclave Drive), the 10-foot pier access easement, and the pier or boating facility.
- Architectural review: All exterior construction, additions, painting, or changes must be approved in writing by the Architectural Control Committee (the three board members). Plans are deemed approved if not acted on within 60 days. The committee can deny based on aesthetics alone.
- Minimum home size & construction: Each home must have at least 3,500 square feet of enclosed, heated living area (excluding garages, decks, porches). Exterior construction must be completed within 12 months of starting.
- Leasing & rentals: Leases must be for at least six consecutive months unless the board approves a shorter term. The board must approve all leases and proposed tenants, and may perform background checks. The owner remains liable for tenant damage and must provide the tenant a copy of the declaration.
- Pets: No more than four domesticated dogs, cats, or other household pets per lot. They must be leashed and not a nuisance; owners must clean up pet waste. No livestock or poultry.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars, built of concrete, brick, asphalt, or approved material. No boats, campers, trailers, inoperable vehicles, or construction equipment may be visible on the lot or street. Vehicle repairs only in garages, not visible from the street.
- Boat slips & pier use: Each of the three lots is assigned a specific boat slip (Lot 1 gets Slip #1, etc.) for exclusive use. Two day docks are available for all owners on a first-come, first-served basis. Boat slips cannot be leased or rented separately from the lot.
- Assessments & fees: All lots pay equal annual assessments to cover common expenses. A working capital assessment equal to one year's annual assessment is due upon purchase from the declarant. Special assessments require 2/3 owner approval. Unpaid assessments become a lien on the lot and may be foreclosed.
