1721 MACKEREL Townhomes is a two-unit townhome community in Wilmington, NC, governed by a declaration that creates an association of the two unit owners. Each owner owns their unit and an undivided one-half interest in the common areas, and is responsible for maintaining their own unit, limited common areas (driveway, deck), and half of certain shared costs like roof and party wall repairs.
- What you own & maintain: You own your unit and an undivided one-half interest in the common areas. You must maintain your unit's interior and exterior, your driveway, and any limited common areas (e.g., deck). You are responsible for half the cost of roof replacement, common landing repairs, and party wall repairs, unless damage is caused by you or your guests.
- Leasing & rentals: Units may be rented for residential purposes, but rentals of less than the whole unit are prohibited. No timeshares are allowed.
- Pets: Only domestic household pets are allowed, subject to rules adopted by both owners. Pets must be leashed outside, waste must be removed immediately, and excessive noise is prohibited. No commercial breeding.
- Parking & vehicles: No campers, trailers, boats, or similar vehicles may be parked on the property. Only standard pickup trucks (2-ton or smaller) are allowed. No junk or inoperable vehicles. Parking rules may be adopted by the association.
- Architectural review: No exterior changes (painting, structures, fences, satellite dishes, signs) may be made without the unanimous written consent of both unit owners. The exterior color of a unit cannot be changed unless the entire building's color scheme is changed, also requiring unanimous approval.
