What Quail Woods's governing documents say
Quail Woods is a standard single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). This document is the Declaration of Covenants, Conditions and Restrictions for Section 16, binding all lot owners and their successors. It covers property rights, assessments, architectural control, and use restrictions.
- What you own & maintain: You own your lot and the single-family home on it. The HOA maintains common areas (if any), drainage easements (Class 1), and entrance signage. You are responsible for maintaining your home, yard, and Class 2 drainage swales on your lot.
- Assessments & fees: Annual assessments are set by the HOA board, with a maximum annual increase of 5% without a 2/3 vote of members. Special assessments for capital improvements also require a 2/3 vote. A one-time $50 working capital fee is due from the first owner at closing. Assessments are a lien on the lot.
- Architectural review: All exterior construction, additions, fences, and alterations require written approval from the Declarant or an architectural committee. Plans are deemed approved if no decision is made within 30 days. Minimum house size is 1,150 heated square feet.
- Leasing & rentals: No specific lease term minimum is stated. Owners may delegate use of common areas to tenants. The document does not restrict the number of rentals or require lease registration.
- Pets: Only domesticated dogs, cats, or other household pets are allowed, not for commercial breeding. Pets must be leashed when outside. Outdoor pet shelters require Declarant approval.
- Parking & vehicles: Boats, campers, trailers, motor homes, trucks over 1 ton, and similar vehicles must be stored out of sight (e.g., in a garage) unless written permission is obtained. No motorized dirt bikes or ATVs are allowed on the property except for maintenance on your own lot.
- Setbacks & lot use: Buildings must be at least 25 feet from the front lot line, 8 feet from side/rear lines (5 feet for detached garages). No mobile homes, trailers, or commercial activity.
