Legacy at Brittany Lakes is a standard single-family home HOA in Wilmington, NC. This document is the full Declaration of Covenants, Conditions and Restrictions (CC&Rs) that binds all lot owners. It covers what you own, what the association maintains, architectural rules, and use restrictions.
- What you own & maintain: You own your lot and the single-family home on it. The association maintains common areas, drainage facilities, entrance signage, and lighting. You are responsible for maintaining your lot, including drainage easements, and for water and sewer charges from New Hanover County.
- Architectural review: All exterior construction, additions, fences, and changes require prior written approval from the developer or architectural committee. Plans are reviewed for harmony of design. If no decision within 30 days, approval is deemed given. Minimum house size: 1,500 sq ft finished (or 1,400 sq ft with attached garage). Exteriors must be completed within 12 months of starting construction.
- Assessments & fees: Annual assessments are set by the board and can increase up to 5% per year without a vote; above 5% requires 2/3 vote of each membership class. Special assessments for capital improvements also require 2/3 vote. Assessments are uniform per lot and become a lien if unpaid. The developer may choose not to levy assessments while actively developing.
- Leasing & rentals: No specific lease term minimum is stated, but owners may delegate common area use to tenants. The document does not restrict the number of rentals or require lease approval.

Fences must be behind the front corners of the house, max 6 ft, wood or chain link, with developer approval. Signs limited to 6 sq ft 'For Sale' or 'For Rent' signs.
- Stormwater & drainage: No structures, shrubs, or trees in drainage easements. Lots adjacent to drainage ditches or ponds must maintain a berm to prevent sheet flow. Impervious coverage per lot limited to 3,800 sq ft. Owners must stabilize erosion within 60 days of occupancy.
