Brittany Lakes is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). These restrictions apply to Section 1A and Section 2, and they bind all lot owners. The community is designed for residential use only, with an HOA that maintains common areas and amenities.
- Property use & restrictions: All lots are for single-family residential use only. No commercial activity, noxious trades, or nuisances are allowed. Temporary structures, trailers, mobile homes, tents, and garage apartments are prohibited as living quarters.
- Building & design standards: Minimum dwelling size is 1,400 sq ft with an attached garage (or 1,500 sq ft without a garage), measured by exterior foundation, excluding porches, garages, and storage. Front setback is at least 25 feet; side setbacks are at least 10 feet (or 5 feet for other structures). Building plans must be approved by the developer (or deemed approved after 20 days if no response).
- Pets: Only domesticated dogs, cats, or other household pets are allowed. No commercial breeding or keeping of animals that become a nuisance.
- Fences & signs: Fences cannot exceed 6 feet in height and must be set back behind the rear corners of the house. Wood or chain-link is standard; decorative fencing (split-rail, brick, wrought-iron) up to 4 feet may be allowed with developer's written consent. Signs are limited to 'For Sale' or 'For Rent' signs no larger than 6 square feet.
- Vehicles & storage: Boats, recreational vehicles, travel trailers, and utility trailers must be stored in a garage or screened area not visible from the front or rear of the lot. Inoperative junk cars are prohibited and may be removed by the developer at the owner's expense.
- Satellite dishes & antennas: Satellite TV dishes, radio, and television antennas are expressly prohibited on any lot.
- HOA assessments & membership: Every lot owner automatically becomes a member of the Brittany Lakes Club and Homeowners Association and the Coastal Carolina Owners Association. Annual assessments are set by the board and can increase up to 20% per year without member vote; higher increases require a 51% member vote. Special assessments for capital improvements also require 51% member approval. Assessments are a lien on the lot and a personal obligation of the owner.
- Developer control & amendment: The developer retains control of the HOA until 75% of lots are sold. The declaration can be amended by the developer (until Dec 31, 1993) or by a 60% vote of lot owners. The developer also has the right to grant utility easements and convert lots to streets or recreational use.
