Covey Commons is a planned community in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that applies to all lot owners. It covers property rights, assessments, use restrictions, architectural control, and maintenance obligations.
- What you own & maintain: You own your lot and the dwelling on it. The association owns and maintains the common elements (e.g., private roads, open space, stormwater ponds). You must keep your lot free of weeds, debris, and unsightly conditions, and maintain all structures in good repair.
- Assessments & fees: Annual assessments fund common area maintenance, insurance, and operations. Special assessments require 2/3 owner vote (except for certain developer reimbursements). A $200 working capital fee is due at closing from the developer. Assessments are a lien on your lot if unpaid.
- Architectural review: Exterior changes (including painting, fences, solar panels, and new structures) require prior written approval from the Architectural Control Committee. The committee has 30 days to respond and can deny based on aesthetics. Fences are allowed with approval; clotheslines are prohibited.
- Use restrictions: Lots are for single-family residential use only. Minimum heated floor area is 1,800 sq ft (excluding porches, decks, garages). No commercial activity, nuisances, temporary structures, or subdividing without approval. No boats, campers, trailers, or inoperable vehicles may be stored on lots or streets. Repairs must be in garages, not visible from the street.
- Pets: Domestic dogs and cats are allowed but not for commercial purposes. They must be leashed or controlled at all times. The board may adopt rules on number, type, and size of pets.
- Signs & antennas: Signs (including for-sale or for-rent) are prohibited without board permission, except developer signs. Satellite dishes over 18 inches and outside antennas require approval; dishes under 18 inches not visible from the street are allowed.
- Developer rights: The developer retains special rights (e.g., to appoint the board, annex additional property, amend the declaration without owner vote until the control period ends on December 31, 2026, or when Class B votes equal Class A votes). The developer also controls architectural review during that period.
