Greenview Ranches is a single-family home subdivision in Wilmington, NC, governed by a declaration of restrictions recorded in 1964. These covenants run with the land and bind all lot owners until 1994, with automatic 10-year extensions unless a majority votes to change them.
- Residential use only: Lots may be used only for residential purposes. Only one detached single-family dwelling (max 2.5 stories), a private garage for up to 2 cars, and other incidental residential buildings are allowed.
- Architectural review: Building plans, specifications, and plot plans must be approved in writing by the sponsor or a committee of lot owners for conformity and harmony of external design, location, and topography. Approval is deemed given if not acted upon within 10 days of submission. The committee's authority ends January 1, 1994, unless a new representative is appointed by a majority of lot owners.
- Setbacks & location: Buildings must be at least 25 feet from the front lot line, 20 feet from any side street line, and 15 feet from any side lot line. No residence or attached appurtenance may be farther than 50 feet from the front lot line.
- Minimum construction standards: No dwelling costing less than $8,000 is permitted. The ground floor area (exclusive of one-story open porches and garages) must be at least 650 square feet for a 1.5, 2, or 2.5 story structure. Homes must be built of brick veneer and completed on the exterior before occupancy.
- Nuisance & temporary structures: No noxious or offensive activity may be carried on, nor anything that becomes an annoyance or nuisance. No trailer, basement, tent, shack, garage, barn, or other outbuilding may be used as a residence, temporarily or permanently.
- Utility easements: A perpetual easement is reserved for the developer over the rear 10 feet of each lot and a 6-foot strip along each side lot line for utility, water, drainage, or other community improvements and maintenance.
- Enforcement & duration: Any lot owner may sue to enforce these covenants. If any covenant is invalidated, the rest remain in effect. The covenants run until January 1, 1994, and automatically extend for successive 10-year periods unless a majority of lot owners vote to change them.
