Willow Woods is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners and are designed to maintain the residential character of the neighborhood.
- Residential use only: All lots must be used for residential purposes only. No noxious or offensive trades or activities are allowed, and no cattle, fowl, hogs, sheep, or goats may be kept on the property.
- Building setbacks & height: Buildings must be at least 35 feet from the front lot line, 10 feet from side lot lines (for one- or two-story structures), and 25 feet from the rear lot line. Unattached garages or outbuildings must be at least 75 feet from the front line and 5 feet from side or rear lines. Structures cannot exceed two stories.
- Minimum floor area: Each dwelling must have a minimum floor area of 1,250 square feet, excluding porches, garages, terraces, outbuildings, and garage apartments.
- Temporary structures & trailers: No trailer, basement, tent, shack, garage, barn, or other outbuilding may be used as a residence. No temporary structure may be used as a residence.
- Lot subdivision: Lots shown on the official plan may not be resubdivided unless the subdivided part becomes part of a whole lot and the remainder becomes part of another whole lot.
- Architectural review: Plans for all dwellings and incidental structures must be approved by the original developers or their heirs/assigns until all lots are sold, after which a three-member building committee elected by lot owners (one vote per lot) will approve plans. Committee members serve three-year terms, with initial terms staggered by lot.
- Duration & amendment: These covenants are binding until January 1983, then automatically extend for successive 10-year periods unless a majority of lot owners vote to change them.
- Enforcement: Any lot owner may sue to enforce these covenants, seeking an injunction or damages for violations.
