What Grainger's Point's governing documents say
Grainger's Point is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) recorded in 1978. These rules apply to all residential lots and are enforced by the developer (Grainger's Point Company) or lot owners. The document covers architectural controls, land use, and maintenance standards, but does not establish a homeowners association or common assessments.
- Architectural review & approval: No building, fence, wall, or other structure may be erected or altered, and no grading or tree removal may occur, without prior written approval from Grainger's Point Company (GPC). Approval may be based on any ground, including aesthetic considerations, in GPC's sole discretion.
- Minimum house size: Each single-family dwelling must have at least 2,000 square feet of enclosed dwelling area, excluding garages, terraces, decks, open porches, and shed-type porches.
- Setbacks & location: Houses must be at least 50 feet from the street and 15 feet from side lot lines. GPC has absolute control over site and location to protect privacy, views, and vegetation.
- Residential use only: All lots are for residential purposes only. No home businesses or occupations are permitted. No trailers, tents, or temporary structures may be used as residences.
- Pets: Only household pets are allowed; no other domesticated animals may be kept on the property.
- Parking & vehicles: Each lot must provide off-street parking for at least three passenger automobiles before occupancy. Parking areas and driveways must be constructed of concrete, asphalt, or crushed stone.
- Fences & signs: No metal fence may be erected nearer the street than the rear line of the house. Front yard fences must be of the same material as the house exterior or other suitable material, with written GPC approval. Signs are limited to a temporary 'For Sale' sign and a property identification sign not exceeding 2 square feet total.
- Maintenance & nuisances: Lot owners must prevent unclean, unsightly, or unkempt conditions. No noxious or offensive activities, or anything that diminishes neighborhood enjoyment, are allowed.
