Bide-A-Wee is a single-family home subdivision in Wilmington, NC, governed by a declaration of restrictions recorded in 1955. These covenants run with the land and bind all current and future lot owners.
- Residential use & building type: All lots except Lot 13 are restricted to residential use. Only one detached single-family dwelling (max 2.5 stories) and a private garage for up to two cars are allowed. A garage apartment may be built after the main dwelling is completed. Lot 13 is exempt from all restrictions.
- Setbacks & minimum size: Main buildings must be at least 50 feet from the front lot line and 10 feet from side lines. Garages and outbuildings must be at least 5 feet from side or back lines. Eaves, steps, and stoops are not counted as part of the building. The main dwelling must have at least 900 square feet of ground floor area (excluding porches, garages, etc.).
- Nuisance & offensive activities: No noxious or offensive activity is allowed on any lot, nor anything that may become an annoyance or nuisance to the neighborhood.
- Temporary structures & outbuildings: No trailer, basement, tent, shack, garage, barn, or other outbuilding may be used as a residence. No temporary structure may be used as a residence.
- Sewage disposal: Individual sewage disposal systems must meet or exceed FHA minimum standards in effect at the time of construction, and must be approved by the local health authority.
- Animals: No domesticated farm animals or fowls are allowed except adequately penned chickens and horses maintained in a manner not offensive to adjoining lot owners.
- Duration & amendment: These covenants run for 25 years from 1955, and automatically extend for successive 10-year periods unless a majority of lot owners vote to change them.
- Enforcement: Any lot owner may sue to enforce these covenants, seeking an injunction or damages.
