What Landfall Center's governing documents say
Landfall Center, Section III is a commercial subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1988. This document sets rules for lot owners (commercial property owners) regarding land use, construction, and maintenance. It is not a residential homeowners' association or condominium.
- Property type & ownership: The property consists of commercial lots (minimum 30,000 sq ft each) intended for commercial office, retail, and restaurant uses. Owners hold fee simple title to their lots and are responsible for all improvements and maintenance.
- Approved uses & restrictions: Each lot's use must be approved in writing by Declarant (or later the Architectural Committee). Only one lot may be a fast-food restaurant (with drive-through) and only one other lot may be a traditional sit-down restaurant. Only one lot may be a convenience store (with or without gas sales). No other uses are permitted without approval.
- Architectural review: All site preparation, construction, landscaping, signs, and exterior alterations require prior written approval from Declarant or the Architectural Committee. Approval may be based on aesthetic or environmental grounds. If no decision is made within 30 days of complete submission, approval is deemed granted.
- Construction & maintenance standards: Exterior construction must be completed within 12 months of commencement (unless delayed by circumstances beyond owner's control). Owners must keep lots safe, clean, and free of debris. Trash receptacles must be screened. All utility lines must be underground. Each lot must have a professionally designed underground sprinkler system.
- Signs & antennas: Only wall signs and free-standing monument/directional signs are allowed, subject to written approval. Exterior radio, TV, and telecommunication antennas or dishes require written permission. No mailboxes or newspaper boxes are permitted on lots.
- Nuisance & compliance: No obnoxious or offensive activity is allowed. Owners must comply with all governmental laws and regulations. Violations may be corrected by Declarant or Committee at owner's expense, with lien rights.
- Amendments & duration: The restrictions run with the land for an initial 10 years (from 1988) and automatically renew for successive 10-year periods unless a majority of affected lot owners record an amendment.
