What Eastport's governing documents say
Eastport is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). All lot owners are automatically members of the Eastport Homeowners' Association, which maintains common areas and enforces rules. This document is the primary declaration of covenants, conditions, and restrictions (CC&Rs) recorded in 1992, supplemented by a separate 2010 declaration for Section 1.
- What you own & maintain: You own your lot and the single-family dwelling on it. The Association maintains common areas, front yard landscaping, and all exterior surfaces of structures (including roofs, siding, decks, and driveways) except glass. You are responsible for interior maintenance and glass surfaces.
- Assessments & fees: Annual assessments started at $250 per lot in 1992 and can increase up to 5% per year without a membership vote; larger increases require a 2/3 vote. Special assessments for capital improvements also require 2/3 approval. Assessments are a lien on the property and a personal obligation of the owner at the time they fall due.
- Architectural review: All exterior construction, alterations, painting, fences, and landscaping must be approved in writing by the Architectural Control Committee (initially the Declarant, later the Board or a committee). Plans are deemed approved if no decision is made within 30 days. Minimum dwelling size is 1,500 square feet (enclosed area, excluding garages and porches).
- Use restrictions: Lots are for single-family residential use only. No business, noxious activity, temporary structures, or recreational vehicles (boats, campers, trailers) allowed without written consent. No satellite dishes or outside antennas without permission. Window coverings visible from outside must be white or neutral. Exterior lights must be clear, white, or yellow bug bulbs.
- Pets: Household pets (dogs, cats) are allowed but not for commercial purposes. They must be leashed when off the lot. No livestock or poultry.
- Parking & vehicles: No inoperable or unregistered vehicles, no tractor-trailers. Vehicle repairs only in garages, not visible from the street. Off-street parking for at least 4 cars must be provided before occupancy. Boats and recreational vehicles may be stored only with restrictions (e.g., boats not in front yard, RV occupation prohibited).
- Leasing & rentals: The document does not restrict leasing or set minimum lease terms. However, all tenants must comply with the declaration.
- What this document doesn't cover: This document does not specify current assessment amounts, pet limits, or age restrictions. It also does not cover rules for the Section 1 addition (2010 declaration), which has separate provisions for minimum square footage (1,000 heated sq ft), fences, and stormwater management.
