HeatherRidge is a single-family home subdivision in Wilmington, NC, governed by a declaration of protective covenants that run with the land. These rules apply to all lot owners and are designed to maintain property values and a uniform residential character.
- Land use & building type: Lots may be used only for single-family residential purposes. Only one detached single-family dwelling (max 3 stories), a private garage for up to 3 cars, and a non-metal accessory building (max 250 sq ft, rear yard, committee-approved) are allowed.
- Architectural review: All building plans, specifications, and plot locations must be approved in writing by a 3-person Architectural Committee for conformity and harmony. If the committee fails to act within 30 days, approval is deemed given unless a lawsuit is filed before completion.
- Dwelling size: No residential structure under 900 square feet (excluding porches, breezeways, steps, and garages) may be erected or remain on any lot without prior written committee approval.
- Setbacks & separation: Minimum setbacks: 25 ft from streets, 50 ft along US/NC highways, 20 ft from development boundary, 10 ft from rear lot lines and paths. Buildings must be at least 5 ft from side lot lines and 10 ft from any other building. Minor violations (≤10% of minimum) may be waived by Declarant.
- Prohibited uses & nuisances: No business, manufacturing, commercial, or professional use (including doctor's office, fraternity house, rooming/boarding house, antique/gift shop). No noxious or offensive activity, signs (except real estate signs), or storage of trade materials.
- Parking & vehicles: Adequate off-street parking must be provided. No street parking of automobiles, boats, trailers, campers, or similar property. Unlicensed or junk vehicles prohibited. Recreational vehicles/boats may be parked only in a garage or screened area, or in association-provided parking if available.
- Fences & mailboxes: Fences, walls, hedges, or mass plantings are allowed only in the rear yard, not extending beyond the rear corners of the dwelling, and require committee approval of location, style, design, and materials. Mailboxes must have a uniform look approved by Declarant; if no response within 60 days, approval is assumed.
- Animals: Only house pets are allowed; no animals or poultry of any other kind may be kept.
