Harnett Pointe is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Protective Covenants. These covenants run with the land and bind all lot owners, with a 25-year initial term that auto-renews every 10 years unless a majority of owners vote to change them.
- Land use & building type: Lots are for single-family residential use only. Each lot may have one detached single-family dwelling (max 3 stories), a private garage for up to 3 cars, and a non-metal accessory building up to 250 sq ft (with Architectural Committee approval).
- Dwelling size: Single-story homes must be at least 900 sq ft (excluding porches, steps, garages). Homes with more than one story must be at least 1,200 sq ft. Smaller homes require prior written approval from the Architectural Committee.
- Architectural review: All building plans, specifications, and plot locations must be approved in writing by a 3-person Architectural Committee for conformity and harmony. If the Committee fails to act within 30 days, approval is deemed given. The Committee members serve without compensation.
- Setbacks & separation: Buildings must be set back at least 35 ft from public/private streets, 50 ft from highways, 20 ft from the development boundary, 10 ft from rear lot lines, and 5 ft from side lot lines. No building may be closer than 20 ft to another building. Minor violations (up to 10% of minimum) may be waived by the Declarant.
- Prohibited uses & nuisances: No business, manufacturing, commercial, or professional use (including doctor's office, fraternity house, rooming house, antique shop) is allowed. No noxious or offensive activity, no signs (except subdivision signs), and no storage of trade materials or inventories.
- Temporary structures & antennas: No trailers, tents, shacks, barns, or other outbuildings (except permitted garages and accessory buildings) are allowed. No clotheslines, satellite dishes, or outside antennas without written consent of the Architectural Committee.
- Fences & mailboxes: Fences, walls, hedges, or mass plantings are allowed only in the rear of the dwelling and must not extend beyond the rear corners, with Architectural Committee approval. Mailboxes require prior plan approval by the Declarant to ensure uniform design; if no response within 60 days, approval is assumed.
- Animals: Only house pets are allowed; no other animals or poultry may be kept on any lot.
