Berkleigh Subdivision is a single-family home community in Wilmington, NC, governed by protective covenants that run with the land. These rules apply to all lot owners and are designed to maintain a high-quality residential neighborhood.
- Land use & building type: Lots may only be used for single-family residential purposes. Only one detached single-family dwelling (max 3 stories), a private garage for up to 3 cars, and a non-metal accessory building (max 250 sq ft, rear of lot) are allowed, subject to Architectural Committee approval.
- Dwelling size: No residential structure under 1,100 square feet (excluding porches, breezeways, steps, and garages) may be erected without prior written approval from the Architectural Committee.
- Architectural review: All building plans, specifications, and plot locations must be approved in writing by a 3-person Architectural Committee appointed by the Declarant. Approval is deemed given if no response within 30 days or if no suit to enjoin is filed before completion.
- Setbacks & separation: Front setback: 25 ft from streets, 50 ft along highways. Rear setback: 10 ft. Side setback: 5 ft from side lines, with at least 10 ft between buildings. Periphery setback: 20 ft from development boundary. Minor violations (≤10%) may be waived by Declarant.
- Business & nuisance prohibitions: No business, manufacturing, commercial, or professional use is allowed. No noxious or offensive activity, signs (except subdivision signs), or storage of trade materials. Residences may not be used as offices, fraternity houses, rooming/boarding houses, or shops.
- Parking & vehicles: Off-street parking must be provided by each owner. Street parking is not permitted. Boats, trailers, campers, and similar items must be parked in a garage or screened area. No unlicensed or junk vehicles on lots, streets, or common areas.
- Pets & animals: Only house pets are allowed; no other animals or poultry may be kept on the property.
- Fences & mailboxes: Fences, walls, hedges, or mass plantings are only permitted behind the dwelling and must be approved by the Architectural Committee. Mailboxes require prior approval of design and location to ensure uniform appearance; if no response within 60 days, approval is assumed.
