Marwood Estates is a single-family home subdivision in Wilmington, NC, governed by protective covenants that run with the land. These rules apply to all lot owners and are designed to maintain a high-quality residential neighborhood.
- Land use & building type: Lots may only be used for single-family residential purposes. Only one detached single-family dwelling (max 3 stories), a private garage for up to 3 cars, and a non-metal accessory building (max 250 sq ft, rear yard, with architectural committee approval) are allowed.
- Architectural review: All building plans, specifications, and plot locations must be approved in writing by a 3-person Architectural Committee for conformity and harmony. If the committee fails to act within 30 days, approval is deemed given unless a lawsuit is filed before completion.
- Dwelling size: No residential structure under 1,600 square feet (excluding porches, breezeways, steps, and garages) may be built without prior written approval of the Architectural Committee.
- Setbacks & separation: Buildings must be set back at least 35 feet from streets, 50 feet from highways, 20 feet from the development boundary, 10 feet from rear lot lines, and 5 feet from side lot lines. No building may be closer than 10 feet to another building. Minor violations (up to 10% of minimum) may be waived.
- Business & nuisance prohibition: No business, manufacturing, commercial, or professional use is allowed. No noxious or offensive activity, signs (except real estate signs), or storage of trade materials. Uses like doctor's offices, fraternity houses, rooming houses, antique shops, and gift shops are specifically prohibited.
- Animals: Only house pets are allowed; no animals or poultry of any other kind may be kept.
- Parking & vehicles: Adequate off-street parking must be provided. Street parking is not permitted. Boats, trailers, campers, and similar items must be parked in a garage or screened area. No unlicensed vehicles or junk cars may be parked on lots, streets, or common areas.
- Fences & mailboxes: Fences, walls, hedges, or mass plantings are only allowed in the rear yard behind the dwelling and require Architectural Committee approval. Mailboxes must have a uniform look; plans and location must be submitted to the Declarant for approval (deemed approved if no response within 60 days).
