Danbury Forest is a single-family home subdivision in Wilmington, NC, governed by a declaration of protective covenants that run with the land. These rules apply to all lot owners and are designed to maintain property values and a uniform residential character.
- Land use & building type: Lots may be used only for single-family residential purposes. Only one detached single-family dwelling (max 3 stories), a private garage for up to 3 cars, and a non-metal accessory building (max 250 sq ft, rear of dwelling, with architectural committee approval) are allowed.
- Dwelling size: No residential structure under 900 square feet (excluding porches, breezeways, steps, and garages) may be built without prior written approval from the Architectural Committee.
- Architectural review: All building plans, specifications, and plot locations must be approved in writing by a 3-person Architectural Committee for conformity and harmony of design. If the committee fails to act within 30 days of submission, approval is deemed given.
- Setbacks & separation: Buildings must be set back at least 25 ft from streets, 20 ft from the subdivision boundary, 10 ft from rear lot lines, and 5 ft from side lot lines. No building may be closer than 10 ft to another building. Minor violations (up to 10% of minimum) may be waived by the declarant.
- Business & nuisance prohibitions: No business, manufacturing, commercial, or professional use is allowed. No noxious or offensive activity, no signs (except real estate signs), and no storage of trade materials or inventories. Residences may not be used as doctor's offices, fraternity houses, rooming houses, boarding houses, antique shops, or gift shops.
- Parking & vehicles: Each lot owner must provide adequate off-street parking. Street parking is not permitted. Boats, trailers, campers, and similar items must be parked in a garage or screened area. No unlicensed vehicles or junk cars may be parked on lots, streets, or common areas.
- Pets: Only house pets are allowed; no animals or poultry of any other kind may be kept.
- Fences & mailboxes: Fences, walls, hedges, or mass plantings are allowed only in the rear of the dwelling and must not extend beyond the rear corners, with architectural committee approval. Mailboxes require prior approval of design and location from the declarant to ensure uniform appearance; if no response within 60 days, approval is assumed.
